CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Hewlett-Packard Canada for automatically updating and programming its printers in such a way that they can no longer recognize and accept third-party ink cartridges. HP’s actions demonstrate unfair practices and anti-competitive conduct that it knows or should have known would cause injury to its consumers.
Around September 13, 2016, thousands of HP Printer owners started experiencing problems and crashes with their HP Printers. Several models of HP Printers underwent a firmware update, rendering them incompatible with ink cartridges that were not manufactured by Hewlett-Packard. Consequently, the update caused damages to consumers who had already purchased third party ink cartridges, as they could no longer be used.
This issue is estimated to affect at least the following HP Printers:
• OfficeJet 6220 series
• OfficeJet Pro 6230 series
• OfficeJet 6820 series
• OfficeJet Pro 6830 series
• OfficeJet 8600 series
• OfficeJet Pro X series
Consumers of HP Printers did not consent, nor were they ever informed of this plan to program a rejection of third party ink cartridges. As a result of this update, consumers can now only purchase HP branded ink cartridges, which cost approximately twice as much as other cartridges which used to be compatible with HP printers. The update has caused a reduction in the HP Printer’s value and usefulness, given that it has become much more expensive to operate. Further, HP’s express warranty accompanying the HO Printers contemplates the use of non-HP-manufactured replacement cartridges in HP printers.
The class action lawsuit identifies the group of affected persons as:
• All residents in Canada who have purchased and own one or more HP OfficeJet, OfficeJet Pro and/or OfficeJet Pro X line of printers that was modified to reject third-party ink cartridges.
