CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Deoleo, the importer, marketer, and seller of Bertolli brand olive oil products on behalf of individuals who have purchased certain Bertolli olive oil products, which were labelled as “IMPORTED FROM ITALY” and/or “EXTRA VIRGIN” (EVOO), including Bertolli Extra Virgin Olive Oil (Originale Extra Virgin and Gentile Extra Virgin), Bertolli Extra Light Olive Oil (Gentile Olive Oil), and Bertolli Classico Olive Oil (the “Bertolli Olive Oil Products”).

The class action involves the deceptive, misleading, false, and unfair advertising of the Bertolli Olive Oil Products as: (i) being made in Italy when in fact, they are made from a substantial amount of olives grown and/or oil pressed in many countries other than Italy – at best, the Bertolli Olive Oil Products are “packed” or “bottled” in Italy and nothing more; and (ii) being of the extra virgin grade when they know that due to their use of substandard, clear (non-light protective) bottles, and unprotected transport methods and storage procedures, the oil will degrade such that it will not qualify as (or can be defined as) “extra virgin” olive oil at the time of sale and/or well before the “Best Before” date. The Defendants, prominently displayed ““IMPORTED FROM ITALY” and/or “EXTRA VIRGIN” on the product packaging in order to misrepresent to consumers that the ingredients were either imported from Italy and/or of the extra virgin quality when they were not.

As a result, consumers were induced into purchasing Bertolli Olive Oil Products that do not live up to their reasonable expectations, thereby causing them economic damages equal to the purchase price of these products.
