U.S. Class Action Complaint
CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against HomeAway and its vacation rental websites, HomeAway.com, VRBO.com and VacationRentals.com for damages relating to its unilateral breach of contract to owners of rental properties by charging rental fees to travellers, unrelated to the vacation property itself.
HomeAway promised and represented to homeowners that it would not charge travellers additional fees and would remain free for travellers. Based on this representation, thousands of homeowners entered into year-long contracts for the right to list their rental vacation properties on HomeAway’s rental marketplace websites. In exchange, homeowners paid HomeAway annual subscription fees of thousands of dollars.
The class action lawsuit alleges that on February 9, 2016, HomeAway unilaterally changed its contract with the homeowners by changing its business model to charge additional “service fees” to travellers in the amount of 4% to 10% of the rental rate of the vacation property. This has substantially reduced the number and value of bookings by travellers and has resulted in thousands of dollars of losses by homeowners.

All residents in Canada who purchased a subscription to list properties for rent on one or more of HomeAway’s websites before February 9, 2016, or any other group to be determined by the Court.
