CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit out of Ontario and Quebec against outlet retailers such as The Gap and Banana Republic (among others) for allegedly deceiving customers by purposefully manufacturing and selling low quality products for their outlet stores and passing them off as regular store items supposedly sold at a "discount" or as being "on sale".
The Gap and Banana Republic (among others) and others are alleged to have deceived customers by giving the false impression that their factory outlet stores are selling the same products as their regular retail clothing stores. In fact, the outlet stores are selling lower quality clothing manufactured specifically for the outlet stores and were never intended to be sold at the regular stores. The retailers manufacture inferior quality items that resemble items sold in the traditional retail stores thus deceiving their outlet store customers.
In addition, outlet stores use other tactics to deceive customers into believing that they are getting a "good deal" on an item. Outlet stores will offer fake markdown prices by placing false "regular" prices on the items to make the "sale" prices appear like the customer is getting a bargain. Other tactics used are false "MRSP"s or "compare at" pricing, which were never the actual prices of the outlet items being sold.
These strategies exploit the expectation of outlet mall shopping customers looking for the same products that they thought was once sold at the traditional retail store but for a discount. Instead they are offered a product for sale that was never sold in the traditional retail stores and/or is of a lesser quality.
