CONSUMER LAW GROUP has filed a national class action lawsuit against Aeroplan Inc., The Toronto Dominion Bank, and Canadian Imperial Bank of Commerce with respect to the clawing back of Welcome Bonus Points given to Aeroplan account holders upon signing up for a second TD or CIBC Aeroplan Visa credit card.

In October 2024, Aeroplan Inc. notified an estimated 17,000 Aeroplan account holders that Welcome Bonus Points given to them upon signing up for a second Aeroplan credit card with TD or CIBC were being rescinded or clawed back. Aeroplan, TD, and CIBC signed up these account holders to Aeroplan Visa credit cards without ever notifying them that they may not be eligible for Welcome Bonus Points despite collecting their Aeroplan account numbers as part of the application process.

TD and CIBC could have – but apparently did not – verify whether account holders already held Aeroplan credit cards, disentitling them from receiving additional Welcome Bonus Points. Aeroplan did not take any steps to notify or otherwise inform TD or CIBC new cardholders that they were not eligible for Welcome Bonus Points at the time of application. Account holders therefore signed up for new Aeroplan Visa credit cards with TD or CIBC on the assumption that they were entitled to Welcome Bonus Points advertised to entice them to acquire said cards.

As a result of Aeroplan, TD, and CIBC’s conduct, several thousand Aeroplan account holders signed up for credit cards, incurred expenditures, and paid annual fees they would not have if they had been made aware that they were not eligible for Welcome Bonus Points on their second Aeroplan credit cards. Affected Aeroplan account holders were deprived of at least 10,000 points, which has an estimated monetary value of $100-$150.

Consumer Law Group believes action must be taken for Aeroplan account holders who had their Welcome Bonus Points unreasonably and arbitrarily clawed back without warning after Aeroplan, TD, and CIBC earned merchant interchange fees and after Class Members incurred annual fees, and other charges from the use of their TD or CIBC Aeroplan Visa credit cards.
