Facebook App Privacy Canadian Class Action

CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Facebook on behalf of all Facebook users whose Facebook data: (a) was accessed by a third-party by way of, or in connection with, a Facebook app and (b) transmitted to a third-party, whether in exchange for payment or otherwise.

The class action alleges that the social media giant violated privacy and consumer-protection laws when it permitted app developers and other third parties to exploit its lax enforcement policies.

As an example, in 2014, Facebook allowed the app developer, “This is my digital life / thisismydigitalife”, which provided personality quizzes to Facebook users, to harvest user data and to send it off to third-party companies. “This is my digital life” prompted users to give access to their personal information as well as that of their Facebook friends. When Facebook users complied with this request, Facebook data that their friends had allowed them to see were gathered by an English company, GSR, for sale to another English company, GSL Elections. The data eventually was transferred to Cambridge Analytica.

The class action alleges that at least beginning with this example, Facebook has breached its agreements with its users, violated its own policies, and broke privacy and consumer-protection laws.

As Facebook CEO Mark Zuckerberg admitted in the wake of these revelations:

“But it’s clear now that we didn’t do enough. We didn’t focus enough on preventing abuse and thinking through how people could use these tools to do harm as well. That goes for fake news, foreign interference in elections, hate speech, in addition to developers and data privacy. We didn’t take a broad enough view of what our responsibility is, and that was a huge mistake. It was my mistake.”

The lawsuit seeks compensation for those affected by the secret data usage, injunctive relief to ensure that Facebook users are not injured again, and a declaration that this behaviour was illegal.
