CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Graco Canada Inc. for falsely and misleadingly representing and advertising its children’s “TurboBooster” and “Affix” booster car seats (the “Booster Seats”) as “side-impact tested” and safe for children as small as 40 pounds.
Graco’s labels and marketing claims lead parents of young children into believing that the Booster Seats provide side-impact protection without revealing that those representations are virtually meaningless. In reality, Graco designs their own testing, “do not publish or share internal crash test results”, and has “set [their] own testing protocols.
Notably, there are no federal or provincial standards for side-testing of booster seats. Graco made up their own “test” and are telling the consuming public that their Booster Seats passed when they, in fact, they do not pass any test that definitively establishes the safety of the seat for children in a side-impact collision.
According to a February 6, 2020 report by ProPublica, a non-profit investigative journalism organization, during a recent side-impact test performed on a Graco TurboBooster, a child-sized dummy in the booster seat hurtled out of the shoulder belt, careening far outside the boundaries of the booster seat, in a way rendering a child’s head, neck and spine vulnerable.
The lawsuit investigation is being pursued on behalf of individuals who have purchased a Graco TurboBooster or Affix booster seat.
