CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Hewlett-Packard Canada for automatically updating and programming its printers to prevent them from recognizing and accepting third-party ink cartridges and for deliberately preventing the scanning and faxing functions of its All-in-One Printers from operating when one of the four ink cartridges is low on ink, empty, or removed from the printer unless and until it is replaced by an HP ink cartridge. HP’s actions demonstrate unfair practices and anti-competitive conduct that it knows or should have known would cause injury to its consumers.
Around or shortly after September 2022, and again in early 2023, thousands of HP Printer owners started experiencing problems and crashes with their HP Printers. Several models of HP Printers underwent a firmware update, rendering them incompatible with ink cartridges that were not manufactured by Hewlett-Packard but that could previously be used in HP Printers and All-in-One Printers. Consequently, the update caused damages to consumers who had already purchased third party ink cartridges, as they could no longer be used.

Consumers of HP Printers did not consent, nor were they ever informed of this plan to program a rejection of third party ink cartridges. As a result of this update, consumers can now only purchase HP branded ink cartridges, which cost approximately twice as much as other cartridges which used to be compatible with HP printers. The update has caused a reduction in the HP Printer’s value and usefulness, given that it has become much more expensive to operate. Further, HP’s express warranty accompanying the HP Printers contemplates the use of non-HP-manufactured replacement cartridges in HP printers.
In addition, HP has deliberately designed the software installed in its All-in-One Printers to prevent the scanning and faxing functions from operating when one of the four ink cartridges are low in ink, empty, or removed. This is despite the fact that no ink is required to scan documents or to send pre-printed documents via fax. As a result, owners of All-in-One Printers are forced to purchase HP ink cartridges to continue using the scanning and faxing functions.

The class action lawsuit identifies the group of affected persons as:
All persons resident in Canada who have purchased and own one or more HP printers and/or All-in-One printers that were modified to reject third-party ink cartridges and/or whose scanning and faxing functions cease operating when one of the four ink cartridges is low on ink, empty, or removed.
