CONSUMER LAW GROUP is investigating a Canada-wide class action against Hino Motors Canada, Ltd. (“Hino”) on behalf of purchasers and lessees of certain model years 2010–2019 Hino trucks.
It is alleged that Hino took part in schemes to manipulate emissions and fuel economy test results. As a result, certain Hino trucks delivered worse fuel economy on the road than during regulatory testing and emitted more pollution than permitted by law. This conduct damaged purchasers and lessees of these trucks who, among other things, paid for more fuel than they would have had these trucks achieved the represented fuel economy.
This class action investigation involves the following vehicles:
• Hino 155 (Model Years 2013-2020)
• Hino 195 (Model Years 2013-2020)
• Hino 238 (Model Years 2011-2020)
• Hino 258 (Model Years 2011-2020)
• Hino 268 (Model Years 2011-2020)
• Hino 338 (Model Years 2011-2020)
• Hino XL7 (Model Year 2020)
• Hino XL8 (Model Year 2020)
• Hino L6 (Model Year 2021)
• Hino L7 (Model Year 2021)
It is claimed that Hino’s scheme involved at least three practices.
1) During regulatory emissions testing, Hino used materially different hardware in testing than what they used in trucks sold and leased to customers;
2) Altering fuel economy test results and manipulating testing to yield false results that appear more advantageous than they actually were;
3) A defect in the trucks’ diagnostic hardware and software which both fail to detect malfunctions in the emissions systems, resulting in trucks emitting more pollution than permitted by law and requiring unnecessary and expensive maintenance.
This issue led to a Class Action in the United States, which resulted in $USD 237.5 million Settlement.
