Inflated and Illegal Milk Prices Class Action
CONSUMER LAW GROUP is investigating a class action lawsuit against certain convenience stores/ depanneurs, such as Couche-Tard, Boni-Soir (Sobeys Quebec), Provi-Soir (Couche-Tard), Proxi (Harnois Énergies), and other independent merchants on behalf of individuals who purchased regular, pasteurized cow’s milk from these stores through a third-party delivery platform, such as Uber Eats, DoorDash, or Skip the Dishes and who were charged a higher price for this milk (not including delivery fees and service charges) than the mandatory allowable maximum under the Règlement sur les prix du lait de consommation.
The milk brands at issue include the Beatrice and Quebon brands.
In Quebec, the price of milk is set by the Régie des Marchés Agricoles et Alimentaires du Québec, in accordance with the Règlement sur les prix du lait de consommation, M-35.1, r. 206.
This regulation provides for maximum allowable charges for regular milk according to region, container size, and fat content.
For example, in Montreal, Sherbrooke, Gatineau, and Quebec City, Quebec, the following maximum retail prices are as follows:

On February 25, 2023, La Presse published an article entitled "Des prix gonflés et illégaux" in which it was reported that of 40 retailers that sell regular milk on Uber Eats in the “Convenience store” section of the app, only one of them complied with the minimum and maximum prices set by the Régie des Marchés Agricoles et Alimentaires du Québec.
On DoorDash, a convenience store on Beaubien Street in Montreal, sells its 4-litre bag of “regular” 3.25% milk for $11.19, against a legal price of $8.61. It will cost $13.49 at a retailer on Parc Avenue on Uber Eats. On Skip the Dishes, a 2-litre of 2% milk was displayed at $6 by a Boni-Soir convenience store. Maximum price allowed: $4.29.
