CONSUMER LAW GROUP has launched a class action lawsuit against LG Chem, Panasonic, Sanyo, Sony, Samsung SDI, Hitachi, and Maxell on behalf of individuals who own any products with a Lithium Ion Rechargeable Battery such as digital cameras, notebook computers, mobile telephones, camcorders, cell phones, personal digital assistants, tablet computers, handheld game consoles, power tools and other electronic devices and equipment.
The class action is based on these companies secretly colluding to fix, raise, maintain and stabilize artificially the price at which Lithium Ion Rechargeable Batteries and products containing a Lithium Ion Battery were sold, so as to restrict or eliminating any competition, thereby artificially inflating the sale price to consumers.
Competition authorities in at least the United States and the European Union have been investigating a conspiracy in the market for Lithium Ion Rechargeable Batteries since at least the first half of 2011. The Antitrust Division of the United States Department of Justice (“DOJ”) is conducting a criminal investigation into anticompetitive conduct in the market for Lithium Ion Rechargeable Batteries.
The class action lawsuit identifies the group of affected persons as:
All residents in Canada who purchased either a Lithium Ion Rechargeable Battery containing a cell manufactured by a Respondent and/or a Lithium Ion Rechargeable Battery Product containing a Lithium Ion Rechargeable Battery containing a cell manufactured by a Respondent, whether directly or indirectly, during the period January 1, 2002 to the present (the “Class Period”), or any other group to be determined by the Court;
