CONSUMER LAW GROUP is investigating a Canada-wide class action lawsuit against Seagate Technology in relation to certain hard drive models’ exceptionally high failure rate.
The models at issue are:
• Barracuda 3TB Hard Disk Drive
• Desktop HDD 3TB
• Backup Plus 3TB External Hard Disk Drive
• GoFlex 3TB External Hard Disk Drive
• Any other Seagate hard drive with model number ST3000DM001
(the “Hard Drives”).
This class action alleges that Seagate failed to disclose, despite longstanding knowledge, that the Hard Drives at issue are defective and predisposed to premature failure. In addition, the replacement Hard Drives that Seagate provided to consumers are also defective and exhibit extremely high failure rates.
Seagate marketed the Hard Drives as reliable and dependable products having low failure rates. However, they have a failure rate that is substantially higher than advertised by Seagate and tend to fail prematurely at an exceptionally high rate in comparison to similar devices sold by other manufacturers.
The fact that the Hard Drives are prone to premature failure is material to consumers not only due to the loss of an expensive product, but because many consumers use the Hard Drives as their primary source of data storage or backup. As a result of Seagate’s failure to disclose the fact that the Drives were defective, consumers have experienced a significant loss of valuable data.
