- Nissan Maxima model years 2004, 2005, 2006, 2007, 2008
- Nissan Quest model years 2004, 2005, 2006, 2007, 2008, 2009
- Nissan Altima model years 2004, 2005, 2006 (with the VQ35 engine)
- Nissan Pathfinder model years 2005, 2006, 2007
- Nissan Xterra model years 2005, 2006, 2007
- Nissan Frontier model years 2005, 2006, 2007 (with the VQ40 engine)
The class action is based on a defect in the Timing Chain Tensioning System, an integral component of the engine, which causes premature failure and requires thousands of dollars in repairs.
The Timing Chain Tensioning System is an integral component of the Nissan Vehicles' engines. When the Timing Chain Tensioning System fails, it can cause a variety of problems, including the inability to accelerate and maintain speed, as well as, catastrophic engine failure, among other issues. When any of these occur while the vehicles are in motion, occupants of the vehicles are exposed to rear end collisions and other accidents.
Had Nissan disclosed the defect to consumers, Nissan would have been forced to replace the Timing Chain Tensioning System before the five-year warranty period expired. Instead where the problem only manifests after the warranty period, which means that drivers pay for the repair out of pocket.
